Internazionale has won a significant legal battle against the upcoming MLS team, Inter Miami. The Italian club, known as Inter Milan, argued that the name ‘Inter’ is closely associated with their brand.
Inter Miami, a new team backed by David Beckham, is scheduled to make its debut next month. Yet, there is now a possibility that they might have to adopt a different name.
According to a report released on Monday, the US Patent and Trademark Office has rejected one of Miami’s main arguments. This ruling does not appear to be in favor of the American team.
Miami’s lawyer, David Winker, indicated that they may have to change their name due to this decision.
In response to the Serie A team’s claims, MLS had two lines of defense. Firstly, they argued that many teams worldwide use ‘Inter’ as part of their name, such as Inter Nashville, Inter Atlanta, Inter Turku in Finland, Inter Leipzig in Germany, and Inter de Grande-Goave in Haiti, among others.
However, the report suggests that MLS does not hold a legitimate proprietary claim to the name ‘Inter.’
The second defense revolved around a potential confusion that may arise among teams already using ‘Inter’ in their name if Internazionale’s trademark application is accepted. Nonetheless, this argument has also been dismissed.
