Domestic violence charges against 49ers’ Reuben Foster are dismissed

On Wednesday, the Santa Clara Judge Nona L. Klippen dropped domestic violence case against San Francisco 49ers linebacker Reuben Foster which will now allow the linebacker to rejoin his team on Thursday. Klippen dropped two charges posed against Foster. The first one is the domestic violence charge along with an allegation of great injury to the body and secondly, a forced attempt to charge for preventing the victim from reporting the crime.

Due to this ongoing case, Foster was not allowed to be a part of the 49ers activities. But now, this will no longer be the case said the general manager of the team, John Lynch in a statement.

Lynch said, “It has been made clear to Reuben that his place on this team is one that must continue to be earned.” He further added that the team would closely monitor Foster’s pending misdemeanor weapon charge. Klippen repeatedly cited that she found a lack of evidence in what Foster’s former girlfriend Elissa Ennis provided at last week’s preliminary hearing did not merit moving it forward. Klippen cited “insufficient cause” to believe either of the two charges “rose to the level” of probable cause, which is the burden of proof needed to move a case to a jury trial.

Klippen said that there was a lack of strong evidence against Foster in either of the two cases charged against him. Klippen spent last few days to look into the evidence and could not find any testimony which showed that Foster had harmed Elissa.

Foster did not comment anything while he left from the Santa Clara Hall of Justice but he did smile and gave a thumbs-up when the media asked on how he was feeling. Jaquiski Tartt and Adrian Colbert, the Niners teammates, attended the hearing to support Foster.
